Privacy Policy for Users

2M Yacht Srls, with registered office at C.da Oliveto, Augusta, SR 96011 – Italy, VAT no. 02108920899 (hereinafter, the “Controller”), provides the following privacy policy for the website www.2myacht.it (hereinafter, the “Site”), as data controller of the personal data of users who browse and are registered on the Site (hereinafter, the “Users”) pursuant to Article 13 of EU Regulation 2016/679 of April 27, 2016 (hereinafter, the “Regulation” or “Applicable Law”). The Controller places the utmost importance on the right to privacy and the protection of its Users’ personal data. For any information regarding this privacy policy, Users may contact the Controller at any time using the following methods:

  1. PURPOSES OF DATA PROCESSING

Users’ personal data will be lawfully processed by the Controller pursuant to Article 6 of the Regulation for the following processing purposes:

  1. Website browsing, in relation to the possibility of detecting User data that is technically necessary, such as the IP address, during navigation of the site.
  2. Sending informational newsletters, upon specific request of the data subject.
  3. Responding to your requests for information submitted through the contact form. Specifically, Name, Surname, Email, and Phone will be requested in order to contact you and respond to your request as effectively as possible, and a Message field to describe the reason for the communication.
  4. Legal obligations, meaning compliance with obligations provided for by law, authority, regulation, or European legislation.

Providing personal data for the purposes listed above is optional but necessary, as failure to do so will prevent the User from browsing the Site, registering on the Site, and using the services offered by the Controller through the Site. With reference to the purposes indicated in points 1/a, 1/b, and 1/c, the legal basis for processing is the performance of the services provided through the Site and requested by you (pursuant to Article 6, paragraph 1, letter b of the Regulation); with reference to the purpose indicated in point 1/d, the legal basis is the fulfillment of a legal obligation to which the data controller is subject (pursuant to Article 6, paragraph 1, letter c of the Regulation).

  1. METHODS OF PROCESSING AND DATA RETENTION PERIOD

The Controller will process Users’ personal data using manual and IT tools, with logic strictly related to the purposes themselves and, in any case, in a way that ensures the security and confidentiality of the data. Users’ personal data will be retained for the time strictly necessary to fulfill the purposes described in paragraph 1 above, or in any case, as required to protect the interests of both the Users and the Controller in civil law matters. Regarding the purpose in point 1.b, the data will be retained until you object to receiving the newsletter, either via the specific link contained in it or by exercising your rights as described in paragraph 4.

  1. SCOPE OF DATA COMMUNICATION AND DISCLOSURE

Employees and/or collaborators of the Controller assigned to manage the Site may become aware of the Users’ personal data. These individuals, who are formally appointed by the Controller as “data processors,” will process Users’ data exclusively for the purposes stated in this policy and in compliance with the provisions of the Applicable Law. Third parties may also become aware of the Users’ personal data and may process such data on behalf of the Controller as “External Data Processors”, such as, by way of example, IT and logistical service providers essential for the operation of the Site, outsourcing or cloud computing service providers, professionals, and consultants. Users have the right to obtain a list of any data processors appointed by the Controller by making a request to the Controller using the methods described in paragraph 4 below.

  1. DATA SUBJECTS’ RIGHTS

Users may exercise the rights granted to them by the Applicable Law by contacting the Controller using the following methods:

  • By sending a registered letter with return receipt to the Controller’s registered office
  • By sending an email to info@2myacht.it;
  • According to the Applicable Law, Users may exercise the rights referred to in Articles 15 and following of the Regulation, in the manner provided for in Article 12 thereof.
  • If you believe that the processing concerning you violates the Regulation, you have the right to lodge a complaint with a Supervisory Authority (in the Member State where you habitually reside, work, or where the alleged violation occurred).
